These Terms of Service ("Terms") govern your access to and use of the My Guy website at myguyapp.com and the My Guy mobile application (together, the "Service"), operated by My Guy Inc. ("My Guy," "we," "us," or "our"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

What My Guy Is

My Guy is a membership-based personal concierge that helps you manage your home, vehicle, pets, errands, self-care, and everyday emergencies. When you submit a request, My Guy understands it, provides guidance, and — where a request calls for it — coordinates qualified third-party service providers on your behalf. My Guy is a coordination and support platform. Except where expressly stated, we do not ourselves perform repairs, medical, legal, financial, or other professional services.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Please notify us promptly of any unauthorized use. You agree to provide accurate information and to keep it up to date so we can serve you well.

Membership and Billing

The Service is offered through paid membership tiers. By subscribing, you authorize us and our third-party payment processor to charge your payment method the applicable recurring fee until you cancel. Memberships renew automatically for successive periods unless cancelled before the renewal date. You may cancel at any time through the app or by contacting us; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. We may change pricing or tiers with reasonable notice.

Requests and Third-Party Service Providers

Some requests are fulfilled by independent, vetted third-party service providers. When a request requires payment for a service, we will present the price and obtain your approval before proceeding, and we may pre-authorize your payment method before a provider is dispatched. Service providers are independent contractors, not employees or agents of My Guy. While we vet providers, we do not guarantee their work, and My Guy is not responsible or liable for the acts, omissions, quality, or conduct of any third-party provider. Any dispute regarding services performed is between you and the provider, though we will make reasonable efforts to help resolve it.

Guidance Is Not Professional Advice

Information and suggestions provided through the Service, including AI-generated guidance, are for general informational purposes only and are not a substitute for professional advice. My Guy does not provide medical, legal, financial, or emergency services. In an emergency, call 911 or your local emergency number immediately. Do not rely on the Service for urgent safety-critical decisions.

Acceptable Use

You agree to use the Service only for lawful purposes and not to misuse it, interfere with its operation, attempt to access it in an unauthorized way, or use it to harass others or request unlawful services. We may suspend or terminate accounts that violate these Terms.

Payments

Payments are processed by a third-party payment processor. By providing a payment method, you authorize charges for your membership and for any services you approve. You are responsible for keeping a valid payment method on file.

Termination

You may stop using the Service and cancel your membership at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, My Guy and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless My Guy from any claims, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
